USA Construction Jobs and Visas for Foreign Workers: What Is Real in 2026

Last reviewed: 25 October 2026. US immigration rules and court rulings are changing quickly this year. Please check the official links in this guide before you pay anyone or accept a job offer.

You may have seen adverts for a “USA Construction Visa Program” that pays you $100,000 to move to America. We looked for it and could not find any US government program with that name, and none of the real work visas pays workers to relocate. This guide explains the routes that do exist for construction workers, what each one really requires, and who is affected by the new US entry restrictions in 2026.

Quick answer

  • There is no single “construction visa”. Construction workers use ordinary employer-sponsored routes such as H-2B (temporary), EB-3 (green card) and, for degree-level professionals, H-1B.
  • You need a US employer first. In every route the employer starts the process and must prove it is hiring for a real job.
  • The employer pays the main sponsorship costs. US rules restrict employers from passing certain costs to H-2B workers, such as petition, attorney and recruitment fees.
  • Waits are long. The EB-3 green card route involves labour certification plus a visa backlog, so expect years, not weeks.
  • Nationality matters a lot in 2026. Some countries, including Nigeria, are under new US visa restrictions that affect immigrant visas.

The $100,000 claim: what is true and what is not

The number $100,000 does appear in US immigration news, but it is a fee some employers were asked to pay for certain new H-1B petitions, not money paid to workers. A presidential proclamation introduced it in September 2025. In 2026 federal courts blocked its collection, and a university immigration office reported on 7 October 2026 that the fee was currently not being required while the government’s appeal continues. A later proclamation extends the policy into 2027, so the position could change again.

Anyone who says a “program” will pay you $100,000 to move, or who wants money from you to enter one, is not describing a real government scheme.

The real routes for construction workers

H-2B: temporary non-farm work

H-2B is for temporary or seasonal non-farm jobs, and construction-related employers sometimes use it. The law caps it at 66,000 visas per fiscal year: 33,000 for jobs starting between 1 October and 31 March, and 33,000 for jobs starting between 1 April and 30 September. Unused numbers do not carry over to the next year.

  • Timing: For jobs starting before 1 April 2027, reports say USCIS announced that 4 September 2026 was the final date to receive new cap-subject petitions. Workers hoping to start in the second half of the year need an employer who files for that period.
  • Country list: H-2B is generally open only to nationals of countries on an official eligibility list. Nigeria was not on the list we could read, which was the November 2024 notice that applied until November 2025. A new list is published each year, so check the latest Federal Register notice for your country.
  • It is temporary. H-2B does not by itself lead to a green card.
  • No worker fees. USCIS has reminded employers that certain fees, including petition, attorney and recruitment costs, may not be collected from H-2B workers.

EB-3: employer-sponsored green card

EB-3 covers skilled workers, professionals and “other workers”, and it can lead to permanent residence. The employer normally has to complete these steps:

  1. Request a prevailing wage from the US Department of Labor.
  2. Run a recruitment test to show no qualified US worker is available.
  3. File a PERM labor certification, then file Form I-140 with USCIS within 180 days of certification.
  4. Wait for a visa number to become available, then complete the visa or green card stage.

One legal-industry guide updated on 12 October 2026 reported that the PERM review alone averaged 336 days for August 2026 decisions, and that the full PERM stage can take 16 to 26 months depending on the estimate. The employer, not the worker, must pay the labour certification costs.

Then comes the visa backlog. The November 2026 Visa Bulletin, reported on 23 October 2026, lists these cut-off dates for the Rest of World category:

EB-3 category (Rest of World)Final action dateDate for filing
Skilled workers and professionals15 June 20241 August 2024
Other workers1 June 20221 July 2022

These dates mean that only applicants whose case was started before that date can move forward now. That puts the skilled category about two years and four months behind today, and the “other workers” category about four years and five months behind. Your country may have its own column in the bulletin, so check the official bulletin for your nationality.

H-1B, TN and L-1: professional routes

These routes are mostly for degree-level jobs such as civil or structural engineers and construction managers. H-1B needs an employer petition for a professional role. TN is only for eligible Canadian and Mexican professionals. L-1 is for people transferring within the same multinational company. None of them is meant for general construction labour.

New in 2026: US entry restrictions by nationality

Presidential Proclamation 10998 took effect on 1 January 2026. It fully restricts entry for 19 countries and partly restricts 20 more. The partial list includes Nigeria, Angola, Benin, Cuba, Gambia, Malawi, Senegal, Tanzania, Togo, Venezuela, Zambia and Zimbabwe, among others.

If you are Nigerian, here is what the published summaries say:

  • Immigrant visas are suspended. That includes the final consular step of an EB-3 green card, apart from limited exceptions, so an EB-3 route is currently blocked for most Nigerian applicants.
  • Visitor (B), student (F, M) and exchange (J) visas are suspended.
  • Work visas such as H-1B, L-1 and O-1 are not suspended, but applicants face extra vetting and shorter visa validity.
  • USCIS processing pause: a February 2026 legal article reported that USCIS was holding final decisions on many benefit requests from nationals of listed countries. A federal court found that pause unlawful in June 2026, but the consular restrictions remain and an appeal may follow.
  • H-2B: we could not find an official statement on how the proclamation affects H-2B, and Nigeria was not on the eligibility list we reviewed, so treat any H-2B offer to a Nigerian with great care.

If you are from another country, check whether it appears in Proclamation 10998 or on the H-2B eligibility list before you spend any money.

How to check a US job offer

  1. Ask for the employer’s full legal name, address and website, and confirm they exist and operate in construction.
  2. Ask which visa route they will use and whether they have filed or will file the petition themselves.
  3. Ask for the written job offer, wage and location, and compare it with official Department of Labor information for that job.
  4. Confirm in writing that you will not be charged for the petition, attorney fees or recruitment.
  5. Pay government fees only through official US government websites, never to an individual.

Red flags and scams

  • Any payment to get a job offer, “sponsorship letter”, “visa slot” or “program registration”.
  • A “construction visa lottery” or “construction visa program.” No such official program exists.
  • Guaranteed visa approval or guaranteed salary.
  • Contact only through social media, WhatsApp or Telegram, with no verifiable company.
  • Fake visa bond demands. Where a bond is required, reports say it is paid only through the official US Treasury system and only after a US officer tells you to pay.
  • Offers that skip the employer. Real petitions are filed by an employer, not sold to you by a middleman.

If you have been targeted, stop paying, keep all messages and receipts, and report it to your local police. You can also email us at info@careerjobss.com so we can warn other readers.

A realistic view

  • Most readers will not be able to do this quickly. Every route needs a willing US employer, and the green card route has multi-year waits.
  • Your nationality can decide the outcome. Check the H-2B country list and the 2026 entry restrictions first.
  • Salary promises are not reliable. Pay depends on the job, state and employer, and the Department of Labor sets minimum wage requirements for sponsored jobs. Be suspicious of any advert that guarantees six figures.
  • Rules can change before you apply. Court rulings and proclamations moved several times in 2026 alone.

Frequently asked questions

Is there a US construction visa that pays $100,000?

No. We could not find any official program like that. The $100,000 figure in the news is an employer fee for some H-1B petitions, and it has been blocked by courts for now.

Can unskilled workers get US visa sponsorship?

It is possible in theory through H-2B for temporary jobs or the EB-3 “other workers” category, but the waits are long and the employer must prove it cannot find US workers. The “other workers” backlog is the longest of the EB-3 categories.

Can my family come with me?

Spouses and children can usually apply to accompany a worker on these routes, but the rules depend on the visa and your nationality. Check the official USCIS page for the specific visa.

Do I need to pay an agent?

You should not need to pay for a job offer or sponsorship. For H-2B, US rules restrict employers from collecting certain fees from workers. If anyone asks you for money before you have a verified employer and a written offer, walk away.

Where can I check the official rules?

Start with the USCIS H-2B page, the Department of State Visa Bulletin and the official proclamation notices linked below.
